Read the manual: Article 13 instructions for use are a lender's first AI Act tool
If you buy a high-risk AI system, the provider's instructions for use are your starting point for compliance. Ask for them early, and check that they are complete.
Article 13 of the AI Act (Regulation (EU) 2024/1689) puts this duty on the provider. A high-risk system must be transparent enough for the deployer to read its output and use it properly (Art. 13(1)). It must come with instructions for use that are concise, complete, correct and clear (Art. 13(2)).
Article 13(3) lists the minimum content. Key items for a bank or lender buying a credit scoring model (Annex III point 5(b)):
- The intended purpose, including the context and conditions of use. - The tested level of accuracy, with its metrics, plus robustness and cybersecurity (Art. 15). - Known or foreseeable situations that could create risks to health, safety or fundamental rights. - Where appropriate, performance for specific groups of people the system is meant to be used on. - Input data specifications, and information to help you interpret the output. - The human oversight measures under Article 14. - Expected lifetime, maintenance and software updates. - Where relevant, how to collect, store and interpret the logs (Art. 12).
Why this matters for you as deployer: Article 26(1) says you must use the system in line with these instructions. Your monitoring under Article 26(5) is also based on them. And if you use the system outside its intended purpose, you risk taking on provider duties yourself (Art. 25).
Practical step: make Article 13 content a contract and procurement requirement. Map it against your model risk files. Flag gaps, such as missing group-level performance data.
Timing: under the Digital Omnibus (Regulation (EU) 2026/1744), these rules apply to Annex III high-risk systems from 2 December 2027. Vendor talks take time, so start now.
